The giveaways are not connected to Facebook, Instagram and Pinterest and are in no way sponsored, supported or organized by Facebook, Instagram and Pinterest. Facebook, Instagram and Pinterest are merely platforms on which benuta GmbH markets giveaway promotions. The recipient of the information provided is not Facebook, Instagram or Pinterest, but benuta GmbH. All questions, comments and/or complaints regarding the giveaways are to be directed exclusively to benuta GmbH.

2. Eligibility

Individuals over the age of 18 who are resident in the EU and UK are eligible to participate. Employees of benuta GmbH and affiliated companies, as well as family members of such employees and their relatives are excluded from participation.

4. Participation

By participating in the giveaway, the participant accepts these conditions of participation. Participation in the giveaway takes place by entering on the associated social media channel. The participation requirements, the participation period, the prizes and information on how to win can be found in the description of the competition on the respective social media channel. benuta GmbH reserves the right to cancel or terminate the competition at any time. This applies in particular in the event of force majeure or if the competition cannot be carried out or continued for other (organizational, technical or legal) reasons. Participants are not entitled to any claims in such a case. The purchase of products from benuta GmbH or external competition partners does not increase the chance of winning.

5. Winner Selection

Winners will be selected at random (https://instabom.com/ or https://wask.co/ or equivalent). The prize is not transferable or exchangeable by the winner(s).

6. Winner Notification

Winners will be notified via Instagram direct message, Facebook direct message or Pinterest message within 7 days following the competition. The claim to the prize will be forfeited and awarded to another participant if the winner does not respond to the prize notification within seven days, if all necessary contact information is not provided within the specified period, or if the winner does not comply with these terms and conditions.

7. Prize

All information about the prize can be found in the competition on the respective social media platform itself. A cash payment of the prize is not possible.

8. Dispatch of the prize

The prize will be dispatched by us or our competition partners. The prize will be delivered by email/Instagram direct message, Facebook direct message or Pinterest message to the winner only. Delays may occur due to public holidays. The participant is responsible for the accuracy of the data.

The designated controller is jointly responsible for the data processing on the Facebook fan page on which the competition is organized together with Facebook (Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2 Ireland) within the meaning of Art. 26 DSGVO).

1. Processing of your personal data in the context of the competition

We process your personal data for the proper implementation and operation of the competition and, in particular, for sending the prize.

In order to carry out the competition, the profile name and, if available, the first and last name of the respective participant are collected and stored. In order to send the prize, we also collect the e-mail address of the winner(s).

The legal basis for this processing of your personal data is Art. 6 (1) point b GDPR (implementation of pre-contractual measures and performance of a contract).

2. Storage period

After the end of the competition, your personal data processed within the scope of the competition will be deleted no later than 3 months after the end of the competition, unless there is effective consent for further processing (e.g. with regard to the sending of newsletters) and/or there is no continued legitimate interest on our part in further storage.

10. Legal Process

The recourse of the courts is excluded.

11. Exclusion of Liability

benuta GmbH is not liable for damages in connection with participation in the giveaway or with the acceptance and use of the prize, unless the giveaway provider or its vicarious agents act intentionally or with gross negligence. This does not affect any claims for compensation due to injury to life, body and health or essential contractual obligations.

12. Severability Clause

Should one or more of the above clauses be or become void, ineffective or unenforceable in whole or in part, the remaining conditions shall remain effective. They shall be replaced by a corresponding valid clause. The same shall apply in the event of a loophole.
